OCC Requests Comments on Proposal to Implement GENIUS Act

The Office of the Comptroller of the Currency (OCC) issued a notice of proposed rulemaking to implement the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act. The notice of proposed rulemaking generally sets forth, and seeks comment on, the regulations that would apply to permitted payment stablecoin issuers and foreign payment stablecoin issuers under the OCC’s jurisdiction and certain custody activities conducted by OCC-supervised entities.
The proposed rule addresses all the regulations the OCC is required to promulgate under the GENIUS Act except for those related to the Bank Secrecy Act, Anti-Money Laundering and Office of Foreign Asset Control sanctions. The OCC will address those in a separate rulemaking in coordination with the Department of the Treasury. Comments are due 60 days from the date of publication in the Federal Register.

The Commodity Futures Trading Commission’s Division of Enforcement issued an advisory following public release of two enforcement cases involving misuse of nonpublic information and fraud with respect to certain prediction markets, also known as event contracts, traded on KalshiEX, a Designated Contract Market.

EBA and ESMA Launch Consultation on Revised Suitability Assessment Framework for Banks and Investment Firms

The European Banking Authority (EBA) and the European Securities and Markets Authority launched a consultation on the revised joint guidelines on the assessment of the suitability of members of the management body and key function holders. In parallel, the EBA is consulting on draft Regulatory Technical Standards (RTS) specifying the documentation and information that large institutions must submit to competent authorities. Together, these elements form the Suitability Package, which aims to harmonize suitability assessments and promote supervisory convergence across the EU. The consultations run until May 25.
