Joseph O’Malley Named Law360 Intellectual Property MVP

NEW YORK – Joseph O’Malley, global co-chair of the Paul Hastings Intellectual Property practice, has been named one of Law360’s 2016 Intellectual Property MVPs.  Law360 reviewed more than 1,000 submissions for the annual MVP awards, with the winners selected on the basis of their “successes in high-stakes litigation, record-breaking deals and complex global matters.”

Joseph O’Malley was recognized as an IP MVP for high-stakes wins on several notable matters. O’Malley had multiple, business-saving wins for Helsinn Healthcare, a family-run company that faced multiple patent challenges to its flagship drug Aloxi®. With the patent for a drug that accounted for more than 90 percent of the company’s revenue at risk, O’Malley implemented a novel approach and set an important precedent shaping the course of patent law concerning the scope of the on-sale bar under the America Invents Act. He successfully argued that Helsinn’s pre-approval activities didn’t make the invention available to the public and accordingly that the on-sale bar wasn’t triggered. O’Malley obtained another victory for Helsinn in a suit against Hospira Worldwide, which sought to move litigation regarding Aloxi® patents outside of the District Court of New Jersey following Helsinn’s earlier success in that jurisdiction. The court ruled in Helsinn’s favor, setting precedent for brand name pharmaceutical companies to bring suit in their forum of choice.

In 2014, Mr. O’Malley was named a Law360 MVP in the Life Sciences category. He has been regularly recognized by Chambers, The Legal 500, Intellectual Property Magazine, Benchmark Litigation, IAM Patent 1000, LMG Life Sciences, and Managing Intellectual Property’s IP Stars.

The Paul Hastings Intellectual Property practice was also recently honored by LMG Life Sciences including General Patent Litigator of the Year (New York), Post Grant Proceedings Attorney of the Year, and Two Impact Hatch-Waxman Cases of the Year.
