The Employment Law Practice

Providing six hours of programs over three days, our speakers discussed the most recent developments in labor and employment law and their implications for employers. Presentations included updates on new pay transparency laws and pay equity litigation; trends in environmental, social, and governance (ESG); NLRB developments for non-unionized and unionized employers alike; employment-related implications of increased anti-trust enforcement; and new cases on wage-and-hour, class actions, and PAGA representative actions.

PAGA: Past, Present, and Future (and What Employers Can Do Now)

There has been a great deal of movement regarding PAGA in recent years. Multiple states have considered enacting PAGA-like statutes and in the 2024 election, California voters will be contemplating whether to repeal and replace PAGA itself. Furthermore, recent decisions regarding PAGA, including the Supreme Court’s decision in Viking River, have provided clarity (and also further questions) regarding topics such as arbitrability, manageability, preclusion, wavier, and settlement.
