Expanding Business Courts’ Reach: HB 40’s Proposed Changes to the Texas Business Court’s Jurisdictional and Removal Procedures

Texas Commercial Litigation practice chair and Complex Litigation and Arbitration practice co-chair Paul Genender and partner Craig Stanfield co-authored an article in Texas Lawyer on House Bill 40, proposed legislation that aims to improve and expand the recently created Texas Business Courts. These courts, established in 2023 with the goal of strengthening Texas’ business-friendly reputation, are specialized venues for resolving complex business disputes.

In this analysis, Paul and Craig summarize key features of the proposed legislation and advise in-house counsel, transactional lawyers and litigators on how best to draft documents and make decisions in the early stages of litigation to invoke the business courts’ jurisdiction.
