Judicial Council Adopts Emergency COVID-19 Rules on Civil Deadlines, Bail

On Tuesday, April 6, 2020, the California Judicial Council adopted three emergency COVID-19 rules affecting all civil matters.1 The new rules:  (i) extend statutes of limitations until 90 days after the Governor declares that the state of emergency related to the COVID-19 pandemic is lifted; (ii) extend the time to bring a civil action to trial or to bring  a new trial by six months; and (iii) allow for remote depositions to proceed upon the election of the deponent or the deposing party without the court reporter being present with the witness. Further guidance is expected as to whether deponents and/or noticing parties may require remote depositions, over the opposing party’s objection.
